Terms of Service

1. Nature of the service

ETFWealthIQ is an educational publisher. The Service publishes research about portfolio construction methodologies, backtested model portfolios, data visualizations, and investment concepts on a regular schedule. All model portfolios are illustrative examples presented for educational purposes.

The Service is not investment advice and is not personalized to your circumstances. ETFWealthIQ is not a registered investment adviser, portfolio manager, or financial planner. We do not manage money, execute trades, or provide one-on-one portfolio reviews. You make all investment decisions and execute all trades independently. See our Disclaimer for the full compliance language, which forms part of these Terms.

2. Who you are contracting with

A sole proprietorship is not a separate legal entity from its proprietor. References in these Terms to ETFWealthIQ, “we,” “us,” or “our” mean that registered business and its proprietor. A postal address for correspondence is available on request at hello@etfwealthiq.com.

3. Eligibility

You must be at least the age of majority in your province, state, or country of residence to subscribe. The Service is a general-audience educational publication and is not directed at children; we do not knowingly collect personal information from anyone under 16 (see the Privacy Policy).

The Service is published from Canada. Nothing on it is an offer or solicitation in any jurisdiction where such an offer would be unlawful, or to any person to whom it would be unlawful to make it. Where local law would require registration as an adviser or dealer in order to publish this material to you, the material is not offered to you.

4. Subscription and billing

Access to paid tiers requires a subscription. Subscriptions are billed on an annual-first basis: in your first year, billing is annual only. Monthly billing may become available at renewal for eligible tiers. Prices are stated on the Pricing page and are charged in advance for the applicable term.

Subscriptions renew automatically at the end of each term at the then-current price unless cancelled before the renewal date. You may cancel at any time; cancellation stops future renewals and takes effect at the end of the current paid term.

30-day refund. If you are not satisfied, you may request a full refund within 30 days of your initial purchase by contacting hello@etfwealthiq.com. Refunds after the 30-day window are at our discretion.

90-day confidence guarantee. Separately from the refund window, the guarantee described on the Pricing page extends your membership if you do not feel more confident about your investment approach after implementing a Blueprint through one quarterly rebalancing cycle. It is a guarantee about the educational experience. It is not a guarantee of investment performance, and no term of these Terms promises any return.

5. Acceptable use

Your subscription is for your own personal, non-commercial educational use. You agree not to:

• Share, resell, sublicense, or redistribute subscriber-only content or Blueprint configurations;
• Scrape, bulk-download, or use automated means to extract content except as expressly permitted;
• Republish the content as your own or use it to operate a competing publication or advisory service;
• Misrepresent the educational content as personalized advice to any third party; or
• Interfere with, disrupt, or attempt to gain unauthorized access to the Service or its infrastructure.

We may suspend or terminate access for violations of this section.

6. Your account and its security

Member access uses a single-use sign-in link sent to your email address rather than a password. Keep access to that mailbox secure: anyone who can read your email can request a link and sign in as you. Do not forward sign-in links, and do not share your account.

You are responsible for activity under your account. Tell us promptly at hello@etfwealthiq.com if you believe your account or mailbox has been compromised. We may invalidate active sessions where we reasonably believe an account has been compromised or shared.

7. Intellectual property and your licence

The ETFWealthIQ name, logo, written content, and the Blueprint portfolio configurations — including allocations, weights, construction methodologies, and avatar-voice copy — are the proprietary intellectual property of ETFWealthIQ and are protected by copyright and other laws. We grant you a limited, revocable, non-transferable, non-sublicensable licence to access and use the content for your own educational purposes for the duration of your subscription. No other rights are granted, and all rights not expressly granted are reserved.

You may implement a Blueprint in your own accounts and keep your own notes and spreadsheets derived from it — that is the point of an educational publication. The licence does not extend to redistributing the configurations themselves, in any format, to anyone else.

The underlying backtesting engine, Boutquin.Trading, is separate from the proprietary Blueprint configurations and is published as open-source software under the Apache License, Version 2.0. The Apache License 2.0 governs your use of that engine independently of these Terms. Open-sourcing a general-purpose engine does not place the proprietary Blueprint configurations into the public domain — the engine is a library; the Blueprints are the product.

8. No investment, tax, or legal advice

Nothing on the Service constitutes investment, tax, legal, or other professional advice, and no content should be construed as a recommendation to buy, sell, or hold any security. Model portfolios are illustrative examples, not instructions. Past performance — including hypothetical backtested performance — is not indicative of future results. Before making any investment decision, consult a qualified professional who understands your individual circumstances, goals, and risk tolerance.

9. Results, backtests, and testimonials

Every performance figure published on the Service is historical and hypothetical. Backtested results are produced by applying a construction methodology to past market data. They are not the results of an actual account, they do not reflect real trading, and they benefit unavoidably from being computed after the period they describe. Live results differ from backtested results.

Any subscriber comment, review, or case study that we publish describes that person’s own experience of the educational material. It is not a representation that you or anyone else will obtain similar outcomes, financial or otherwise, and it is not evidence about future returns. We do not compensate subscribers for testimonials, and we do not present any testimonial as a performance claim.

10. Third-party links and services

The Service links to third-party websites, data sources, and documents, and relies on third-party providers for payment processing, email delivery, and analytics. Those parties are independent of us. We do not control and are not responsible for their content, availability, accuracy, terms, or privacy practices, and a link is not an endorsement. Your use of a third-party service is governed by that party’s own terms.

11. Disclaimers and limitation of liability

The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the content is error-free, complete, or current. The full required disclaimers — including the backtest, Canadian-securities, and open-source disclaimers — appear on our Disclaimer page and are incorporated here by reference.

To the fullest extent permitted by law, ETFWealthIQ and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any investment losses, arising out of or relating to your use of the Service. You use the content and any open-source software at your own risk.

To the fullest extent permitted by law, our total aggregate liability arising out of or relating to the Service or these Terms is limited to the amount you paid us for the Service in the twelve months preceding the event giving rise to the claim.

Some jurisdictions do not permit the exclusion of certain warranties or the limitation of certain damages. Where that is the case, the exclusions and limitations above apply only to the extent permitted, and nothing in these Terms limits any right you have under consumer-protection legislation that cannot lawfully be limited.

12. Indemnification

You agree to indemnify and hold harmless ETFWealthIQ and its proprietor from any claim, demand, loss, or expense (including reasonable legal fees) arising from your breach of these Terms, your misuse of the Service, your redistribution of subscriber-only content, or your presentation of the educational material to any third party as personalized advice.

13. Privacy and data protection

Our handling of personal information is described in the Privacy Policy and the Cookie Policy, which form part of these Terms. One commitment is worth restating here because it is structural rather than a preference: the Service never asks for and never stores your account balances, holdings, income, or brokerage credentials. Risk profiling uses self-selected general categories only.

14. Suspension and termination

You may stop using the Service at any time and cancel as described in section 4. We may suspend or terminate your access if you breach these Terms, if required by law, or if we discontinue the Service. Where we discontinue the Service or terminate without cause, we will refund the unused portion of a prepaid term on a pro-rata basis.

Sections that by their nature should survive termination do survive it, including sections 7 (intellectual property), 8 (no advice), 9 (results), 11 (disclaimers and limitation of liability), 12 (indemnification), and 17 (governing law).

15. Events outside our control

We are not liable for any delay or failure to perform caused by events beyond our reasonable control, including outages at hosting, payment, market-data, or email providers, network failures, acts of government, labour disruption, or natural events. Where such an event materially interrupts publication for an extended period, we will extend affected subscriptions rather than treat the term as consumed.

16. Changes to the service or these Terms

We may modify the Service or these Terms from time to time. Material changes will be communicated by updating the effective date above and, where appropriate, by email. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

17. Governing law and dispute resolution

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in Ontario, without regard to conflict-of-laws rules.

If a dispute arises, the parties will first attempt to resolve it informally by contacting each other. Failing that, the parties will attempt mediation in Ontario. A dispute not resolved by mediation proceeds to binding arbitration in Ontario under Ontario’s Arbitration Act, 1991, and the courts of Ontario have exclusive jurisdiction over any matter not subject to arbitration.

Nothing in this section prevents either party from seeking injunctive relief in a court of competent jurisdiction, or affects any right you may have to bring a claim before a small-claims court or a consumer-protection body where applicable law preserves that right.

18. International use

The Service is published from Canada and is written primarily for readers in Canada and the United States. If you access it from elsewhere, you are responsible for complying with the laws that apply to you, including any local rules on the distribution of investment-related material. Where local law treats this publication as regulated activity, it is not offered to you.

19. Severability, waiver, and entire agreement

If any provision of these Terms is held unenforceable, that provision is severed to the minimum extent necessary and the remainder stays in force. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms; we may assign them in connection with a transfer of the business.

These Terms, together with the Disclaimer, Privacy Policy, and Cookie Policy, are the entire agreement between you and us regarding the Service, and supersede any prior understanding on that subject.
